Please read these Terms and Conditions of Sale (“Terms”) carefully prior to making an online purchase from Andria Arie, LLC (“Andria Arie,” “we,” “us” or “our”) through our Andria Arie website (the “Site”). By purchasing items through the Site, you agree to be bound by these Terms and our Terms of Use, which are incorporated by reference. If you do not agree to all of these Terms, do not purchase any items through the Site.
We reserve the right to change or modify these Terms at any time and in our sole discretion. If we make changes to these Terms, we will post the amended Terms on our Site and update the “Last Updated” date above. We kindly ask you to review these Terms prior to making any purchase through the Site to ensure that you understand the terms and conditions that apply to your purchase.

1. Pricing and Product Availability

   • All products offered for sale through the Andria Arie Site are subject to availability. All prices are shown in U.S. dollars, and applicable taxes and other charges, if any, are additional. All prices are subject to change without notice. We reserve the right to impose quantity limits on any order, reject all or any part of an order, and discontinue offering items without prior notice.

2. Taxes

   • You are responsible for any sales, use, or any other governmental taxes or fees (“Taxes”) due with your purchase of items through our website. We will collect applicable Taxes if we determine we have a duty to do so. All Taxes are in addition to our product prices, meaning our products prices do not include taxes.  We will present an estimate of Taxes to be collected at checkout. The actual taxes charged may be adjusted from the amount shown at checkout. Several factors may cause this adjustment, such as variances between processor programs and changes in rates of Taxes.

3. Payments

   • By providing a credit card or other payment method accepted by us, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third-party payment processor) to charge your payment method for the total amount of your order (including any applicable Taxes and other charges). If the payment method cannot be verified, is invalid or is otherwise not acceptable, your order may be suspended or cancelled. You must resolve any problem we encounter in order to proceed with your order. In the event you would like to change or update payment information associated with your account on the Site, you can do so at any time by logging into your account and editing your payment information. If any of the items in your order are unavailable, we will charge only the prices, Taxes and other applicable charges associated with the items that are included in the shipment.

4. Shipping and Handling

   • You agree to pay any shipping and handling charges shown at the time you make a purchase. We reserve the right to increase, decrease, add or eliminate shipping and handling charges from time to time; however, we will provide notice of the changes applicable to you before you make your purchase. Any delivery dates or times shown as part of the checkout process are estimates only and are not guaranteed. 5. Returns, Exchanges and Refunds

6. Price Adjustments

   • We do not offer post-order price matching when an item’s price drops after you buy it because prices are based on the latest market gem and precious metal values and, therefore, may change regularly. However, if the price of an item you purchase through our website is reduced due to such item becoming a permanent sale item or the item is on sale within 30 days of the date on which you purchased the item, you may contact us to receive a price adjustment. Special and coupon promotions are not eligible for this price protection. 7. Comparison Purchasing

   • We do not allow comparison purchasing since this can cause undue restocking and inventory overhead costs. Comparison purchasing is when several items are purchased with the intent to keep the one you like best and returning the rest of the merchandise. If we believe that comparison purchasing is an issue, your order and/or your returns maybe delayed until we are able to contact you.

8. Errors

   • We attempt to be as accurate as possible and to eliminate errors on our website; however, we do not represent or warrant that the descriptions, pricing or other information on the Site is accurate, complete, or error-free. In the event of an error, we reserve the right to correct such error and revise your order accordingly (which includes charging the correct price) or to cancel your order and refund any amount charged.

    • Please refer to our Privacy Policy for information on how Andria Arie collects, uses, and discloses personally identifiable information from its customers.

11. Product Use

    • All products purchased from us are for your personal use only, and any resale or commercial use of our products is strictly prohibited. Andria Arie reserves the right to refuse to sell any of its products to anyone who violates these terms.

12. Termination

    • Andria Arie reserves the right, in its sole discretion, to terminate your license to use the Site and to block or prevent future access to or use of the Site.

13. Severability

    • If any provision of these Terms and Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions.

14. Advertisements and Promotions

    • Andria Arie promotions are not combinable with other promotions or discounts including vouchers and coupons. Please note that Andria Arie reserves the right to rescind, revoke or terminate our promotions at any time, with or without cause.

15. Disclaimer of Warranty and Limitation of Liability

    • The disclaimer of Warranty and Limitation of Liability provisions of the Terms of Use of the Site are hereby incorporated in these Terms.

16. Applicable Law and Venu

    • These Terms and Conditions and your use of this site will be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, applicable to agreements made and to be entirely performed within the Commonwealth of Massachusetts, without resort to its conflict of law provisions. You agree that any action at law or in equity arising out of or relating to these Terms Conditions shall be filed only in the state and federal courts located in Boston, Massachusetts and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action or proceeding arising out of your use of this site, any purchase from this site, or these Terms and Conditions.

    • You agree that Andria Arie may modify these Terms and Conditions and any other policies on our Site at any time and that posting the modified Terms and Conditions or policies on our Site will constitute sufficient notice of such modification.
